Virtual Talk im Turm: Health Claims in Advertising Botanicals (ECJ Case C-386/23)


In ECJ Case C-386/23, the Advocate General issued his opinion on October 17, 2024, proposing a very strict interpretation of the EU Regulation on Nutrition and Health Claims Made on Foods ((EC) No 1924/2006).

Even though, following a decision of the European Commission in September 2010, the European Food Safety Authority (EFSA) can no longer evaluate health claims made on botanicals, the Advocate General suggests that (EC) No 1924/2006 should be interpreted as precluding botanical substances from being advertised with specific health claims or with reference to non-specific nutritional, health or well-being benefits.
