backEmergency departments operate 24 hours a day, 7 days a week. Patient attendance fluctuates and can be unpredictable as well as overwhelming, resulting in challenges in managing space, staff, and resources. In addition to providing appropriate medical care to patients, hospital EDs must meet a host of legal and business requirements and expectations. One such legal requirement is EMTALA, arguably one of the more powerful healthcare regulations. In December 2016, the OIG issued a final rule that became effective January 2017 that adds additional punch and clarity to EMTALA.
Hospitals and other healthcare companies are attempting to reach additional patient populations and increase their footprint and market share by building freestanding EDs. This type of facility presents a number of both legal and business challenges as providers must ensure that their EDs are sufficiently integrated with the main hospital in order to be treated as a hospital department and not a freestanding urgent care center.
