Dynex Capital Wins Dismissal of $13.8 Million Claim

King & Spalding won a dismissal of a $13.8 million claim for breach of a litigation cost sharing agreement on behalf of client, Dynex Capital. The Receiver for a judgment creditor sued Dynex Capital, seeking to collect damages and attorneys’ fees totaling $13.8 million.  After a trial on damages in the Northern District of Texas, the court concluded that the amount owed to Dynex Capital exceeded the total amount sought by the Receiver and issued its Judgment that the Receiver take nothing, dismissing his claim against Dynex Capital.
