PFAS (Per- and polyfluorinated alkyl substances) are a focus of the Plaintiffs’ bar, regulatory agencies like the EPA, and the general public. King & Spalding has been at the forefront of advising clients on regulatory issues and potential legal liability arising from PFAS exposure since the early 90s. As the legal liability profile has extended beyond PFAS manufacturers to distributors, retailers, and consumer products, and the reach of regulatory action has similarly extended to industries ranging from fast food to cosmetic products, we have continued to demonstrate our ability to anticipate new challenges. Our PFAS team is the point of call for a wide range of clients on mitigating risk, on developing and applying responses to PFAS laws and regulations at the federal and state level, and on defending litigation as it arises, including navigating expansive legal theories in novel contexts.
