People

Jennifer Mencken is a Senior Staff Attorney with the firm’s Trial and Global Disputes group. Her practice focuses electronic discovery issues, particularly with respect to the representation of clients in matters of white-collar criminal defense, internal and government investigations, and complex civil litigation including litigation of complex shareholder derivative actions and False Claims Act cases. Jennifer has experience defending companies in investigations by various government entities, including Congress, DOJ, SEC, EPA, and State Attorneys General, and in development of compliance guidelines and corresponding management training programs.

In her role, Jennifer works closely with clients and vendors to reduce costs, increase efficiency, and improve performance and defensibility across the entire EDRM spectrum.  She provides advice and counsel regarding the vendor selection process, helping with the design, development, and implementation of new discovery tools and best practice procedures.  She has over two decades of experience in managing discovery issues for the firm’s clients, with particular expertise regarding privilege and work product issues.

Jennifer co-authored a chapter, “Predictive Coding from the Defense Perspective: Issues and Challenges,” for a 2016 ABA book titled Perspectives on Predictive Coding and Other Advanced Search Methods for the Legal Practitioner.  In 2014, she also co-authored an article, “How to Develop and Test a Filter to Avoid Producing Privileged Documents,” for the Fulton County Daily Report.
