Brian Hill handles litigation for innovative companies, with an emphasis on disputes involving imported goods. By focusing on clients’ key objectives, Brian brings a strategic approach to resolving unfair competition and intellectual property cases.
Brian is a partner in King & Spalding’s international trade group. He has extensive experience with unfair import investigations at the U.S. International Trade Commission. Brian has represented Complainants and Respondents in all phases of Section 337 disputes, from conception through enforcement proceedings and before U.S. Customs and Border Protection. Brian also litigates related matters in U.S. District Courts.
Brian has achieved outstanding results in cases involving patent and trademark infringement, unfair competition under the Lanham Act, gray market and counterfeit goods, dumping, and antitrust allegations. For example, Brian has helped clients obtain general exclusion orders on three separate occasions (337-1074, 337-1155, and 337-1364), and regularly helps clients defeat exclusion orders sought by others. In district court, Brian argued and successfully avoided transfer of a consolidated group of patent cases, resulting in favorable settlements.
Brian has a background in physics and routinely handles cases involving pioneering technology, including telecommunications, medical devices, and pharmaceuticals. Before joining the firm, Brian was a patent examiner with the U.S. Patent and Trademark Office and reviewed applications related to solar panels. He also worked as an attorney with the ITC.
