On October 2, 2024, our client Becton Dickinson and Company (“BD”), entered into a multi-year payment agreement to resolve the majority of its hernia mesh litigation. The terms of the settlement are confidential and cover cases from both the consolidated litigation in Rhode Island and the federal multidistrict litigation in Ohio. The settlement does not include any admission of liability or wrongdoing, as BD continues to dispute the allegations. However, the company believes this agreement is in the best interest of all parties and will reduce uncertainty for stakeholders involved in settled cases. The team was led by Russell “Chip” Gaudreau (New York) and also included Jessica Gold (New York) and Daniel Phillips (Northern Virginia). King & Spalding’s Strategic Resolution Team provides all-inclusive strategic litigation management and resolution strategies that are narrowly tailored to clients’ financial needs and ultimate goals.
