King & Spalding Obtains Dismissal of a Proposed Class Action Alleging Equifax Violated Antitrust by Excluding Medical Debt Under $500 from Consumer Credit Reports


King & Spalding is defending Equifax in a proposed class action against it and two other competitors, TransUnion and Experian, alleging that the defendants conspired to remove the reporting of consumer’s medical debt below $500 from credit reports in violation of the Sherman Act and California’s Cartright Act.

On January 2, 2025, U.S. District Judge Daniel J. Calabretta ruled that the putative class of medical service providers hadn't established an antitrust injury necessary to claim the credit bureaus had run violated the Sherman Act, and granted the defendants’ motion to dismiss the proposed class action.
