King & Spalding successfully represented Delta Air Lines in a purported class action involving claims for violation of the Racketeer Influenced and Corrupt Organizations Act (“RICO”), Florida’s Deceptive and Unfair Trade Practices Act (“FDUTPA”), and for unjust enrichment related to the marketing and sale of travel insurance policies through the booking path on Delta’s website. The plaintiff alleged that the marketing of the travel insurance products sold by AGA Service Company, Inc. d/b/a Allianz Global Assistance (“AGA”) on Delta’s website booking path was deceptive and in violation of RICO based on Delta purporting to have received an undisclosed “kickback” from AGA in connection with each policy sold through its website. We aggressively defended Delta’s important relationship with AGA, obtaining dismissal of the RICO claim on the pleadings and dismissal of the plaintiff’s FDUTPA and unjust enrichment claims at summary judgment. We also successfully defended against class certification.
